○上海拘束事件、山田代表らの早期釈放を目指して

　去る8月7日中国上海の日本人学校正門前で、日本の市民団体である私たち「北朝鮮帰国者の生命と人権を守る会」の山田文明代表（大阪経済大学助教授）と3人の韓国人協力者（ジャーナリスト）及び7人の北朝鮮難民（元在日帰国者の家族）が中国上海市公安当局によって逮捕され、拘留されました。山田代表らは元在日帰国者の家族である7人を、去年韓国に亡命しているその母親の依頼を受けて、韓国に亡命させるべく奔走している中での逮捕でした。   山田代表ら4人の罪は「不法入国者幇助罪」というものです。しかしこの逮捕、拘留は人道的にも、国際的にも納得のいかない不当なものです。 中国は難民条約に加入し、難民を保護する立場にあります。国内法や中朝両国間協定より国際法が重いことは言うまでもありません。山田代表らは7人の生命を救うために、難民条約と人間の尊厳に立って行動したものです。   山田代表ら4人は7人の北朝鮮難民が北朝鮮に強制送還されることを何よりも心配しています。7人が願っているのは母親のいる貴国への亡命です。その実現のため貴国政府が最大限の努力をして下さることを切に希望するものです。7人は元在日帰国者の家族ですので日本政府に対しても私たちは強く要請しています。 　また3人の韓国人協力者（金基柱、金昇鎮、琴明燮各氏）は人権感覚と正義感に厚いジャーナリストたちです。人間としてもとても立派な人たちです。この人たちの協力なしには元帰国者やその家族を救うことができないほどの正義感に溢れた方たちです。私たちはとても彼らを尊敬しています。ぜひ、貴国の誇る3人のジャーナリストの即時救出のためにお力添え下さい。 2003年8月14日 (木) 午後4時31分   北朝鮮帰国者の生命と人権を守る会からのお知らせです。    現在上海で拘束されている、山田文明名誉代表からのメッセージをお伝えいたします。代表が日本の領事に語ったものです。   「自分は酷い扱いもうけていないし大丈夫だから、家族も皆さんも安心して欲しい。 それよりも、今回同じく拘束されてしまった難民7名（と山田先生はおっしゃってい ます）は、帰国者の親族でもあり、北朝鮮に強制送還されれば酷い処罰を受ける事が 予想される。   私も取り調べの係官に、彼らを強制送還しないようにお願いしているが、守る会も、日韓両国政府が協力し、彼らを北朝鮮に送り返す事が無いよう、中国 政府に働きかけるよう訴えて欲しい。」   また、現在韓国には今回拘束された難民の家族がおります。彼女は60年代初頭に帰国 事業で北朝鮮に渡り、近年韓国に亡命しました。守る会関係者に電話でこう話してい ます 。   「韓国で家族と一緒に暮らしたかったのに、こんなことになって悲しくてたまりませ ん。特に、小さな子供も捕まっていることを思うと心が張り裂けそうです。でも、も し北朝鮮に帰されたら、2度と出てこられないような強制収容所に入れられてしまう か、処刑されてしまうでしょう。何とか難民たちを北朝鮮に送り返さないよう、中国 政府にもお願いいたしますし、日本と韓国の政府もそう中国政府にお願いしてくれな いでしょうか。」   「そして、私達の家族や難民を助けるために捕まってしまった市民団体の人たちに は、ただもうしわけない気持ちで一杯です。日本の政府と国民の皆様、どうか市民団 山田代表等の拘束に対する行動（8月11日、 12日） 　守る会は8月11日午後7時30分から、東京 都江東区住吉の「ティアラ江東」で緊急記者 会見を行なった。会見では宋允復（ソン・ユ ンボク）事務局次長が報告した。同日夕刻、 外務省によって確認されたことだが、山田文 明代表たちが上海市公安当局によって逮捕さ れたという。 他の逮捕者は不明であるが、協 力者で同会メンバーの在日韓国人・金基柱 （キム・キジュ）さん、2名の韓国マスコミ 記者、脱北者9名を含む13名である可能性が あるということであった。 　9名のうち7名は、すでに脱北して韓国に 在住している元在日朝鮮人帰国者の老夫婦の 子供や孫等で、その老夫婦から支援の要請が あって、守る会として3月以来救出に取り組 んできた。他の2名は合流してきた在日帰国 者2世である。 SARSの流行で中国国内の移動 がきびしかったため、脱北者たちはしばらく 北京に潜んでいたが、限界となった。守る会 は4月以来外務省に支援を頼んでいたが、色 よい返事がなかったため、上海の日本領事館 施設へ駆け込むことを計画した。 山田代表は 8月5日に中国に入ったが、駆け込み予定日 の前日にあたる6日夜9時を最後に、日本と の連絡がとれなくなった。外務省に問い合わ せていたが、外務省でも分からないとのこと で、本日（11日）夕刻になって外務省から逮 捕されていることが分かったという連絡が入 った。 　守る会として中国当局に身柄情報の公開を 求める。また日本政府は中国当局に情報の公開と、邦人保護ならびに人道的観点から、彼 らの身柄の安全が確保され、北朝鮮に強制送 還されないよう求める。以上がおおよその報 告内容であった。 　12日は小川名誉代表はじめ守る会メンバー 午後3時に中国大使館に要請書を持って訪れ、門前で受け取ってもらうよう交渉したが らちが明かず、ハンドマイクでアピールした あと、ポストに入れて退散した。 つづいて午 後4時50分から外務省の一室で担当官と面談 した。外務省側は北東アジア課の事務官1 名、邦人保護課の事務官2名の計3名が対応 した。   外務省は北京政府と上海市公安当局に 日本領事と山田氏の面会を申し入れていたそ うで、それがこの日（12日）の午後に実現、 主席領事が1時間面会したということなので、まずその様子を聞き、最後に要請書を渡 して退出、建物の外で待ち構えていた記者団 に会談の模様を報告した。 　外務省の話によれば、7日午後3時〜4時 に11名が日本人学校のそばで拘束された。山 田さんは6日、日本領事館内の文化センターを下見したが、警備がきびしいのであきら め、7日に日本人学校に駆け込もうとして日 本人学校のそばにいるところを上海の公安警 察に拘束されたという。   上海看守署に拘置さ れていて、密入国を組織した容疑で取り調べ られている。本人は元気で、家族に心配しな いでくれと伝えてほしいと言っているそうで ある。 　   外務省は韓国政府とも連絡をとりながら、 山田さんの件が加藤さんのような形で解決さ れることを期待しつつ、一刻も早く帰ってき てほしいと中国側と交渉しているという。ま た、他の人々についても、人道的立場で処理 してくれるよう申し入れているという。 　 ------------------------------------- 外務省と中国大使館に提出した要請書 【外務省への要請文】   山田文明氏を含む中国政府に拘束された全員 の早急な解放を中国政府に要求してください 外務大臣 川口順子　殿 　激動の国際情勢の中、６カ国協議を目前に 控え、日夜日本外交の先頭に立たれてご尽力 されておられることと思います。 　私達市民団体「北朝鮮帰国者の生命と人権 を守る会」は、１９９４年の発足以来、北朝 鮮帰国者、日本人配偶者の人権擁護、また北 朝鮮における政治犯収容所を始めとする様々 な人権抑圧の改善を求めて運動してまいりま した。 　さて、８月１１日、中国公安当局は公式に 外務省に対し、当会代表を務める山田文明大 阪経済大学助教授（５４歳）の逮捕を通告し てまいりました。中国側の報告によれば、同 氏は不法入国を幇助した容疑で逮捕されたと いうことです。 　既に幾つかのマスコミでも報道されており ますように、今回山田文明氏は、中国で帰国 者２世を中心とする北朝鮮難民の救援に韓国 人協力者と共に取り組んでおりました。これ は、北朝鮮からの難民を不法入国者として北 朝鮮に送還する政策をとっている中国におけ る、人道上やむをえない活動であります。こ の救援行動はこの春から日本国外務省とも 様々なご相談をさせていただいたことでもあ ります。 　従来、日本国外務省は、日本国籍者に対し ては北朝鮮を脱出する事ができれば、邦人保 護の観点から直ちに保護することを表明して おられます。また、私達守る会を含む多くの 北朝鮮人権問題に取り組んでいる市民団体の 要請に対し、在日朝鮮人帰国者も日本国籍者 に準ずる保護対象であることもまた明言して こられました。私達は日本外務省のこのよう な姿勢を、人権擁護という視点から高く評価 するものです。 　だからこそ尚更、今回難民救援の途上で逮 捕、拘束された山田文明氏の早期解放と共 に、同じく拘束されている事がほぼ確実と思 われる韓国人協力者および北朝鮮難民全員を 即時解放することを、人権外交の精神から中 国政府に要請してください。 　私達は以下の点を日本国外務省に緊急要請 いたします。 １、 山田文明氏の即時釈放を邦人保護の観 点から中国政府に要請してください。 ２、 山田文明氏と共に拘束されていると思 われる韓国人協力者の安否情報を求めると共 に、彼らの即時解放を韓国政府と協力して中 国政府に要請してください。 ３、 北朝鮮難民が国際的な難民保護の対象 であることは、各人権団体、またUNHCRの報告 田文明氏を逮捕したことを明らかにしまし た。日本国外務省から私たちが報告を受けた 所によりますと、山田氏は不法入国を幇助し た容疑で逮捕されたということです。 　山田代表は，確かに北朝鮮難民の救援を協 力者と共に行っておりました。しかし、世界 各国の人権団体が認め、またUNHCRも最近になって認めているように、北朝鮮難民は貴国も批准している難民条約で保護されるべき人々です。   彼らが北朝鮮に強制送還されれば、山田文明 氏のような人権団体と接触した方は残酷な拷 問を受け、また悲惨な収容所に送られます。北朝鮮刑法を見れば、脱北は政治的反逆罪と見なされており、彼らが政治難民にあたることも明確です。   この北朝鮮難民を救援していた山田文明氏、 及び行動を共にしていた協力者、そして北朝 鮮難民は、いずれも犯罪者ではありません。貴国が彼らを即時解放し、北朝鮮難民につい ては希望する国への亡命を許可することが、国際的な貴国の名誉でもあると考えます。 私達は人権団体として以下の件を要請いたし ます 一、 逮捕拘束している山田文明氏を即時解放してください。 二、 共に拘束されていると思われる韓国人協力者も、また人道的、国際法的には何ら犯 罪を犯してはおりません。彼らもまた即時解 放してください。 三、 have been detained by the Chinese government. August 13, 2003 To: Everyone who loves the human rights 　 　 Our citizen's group, The Society to Help Returnees to North Korea, has requested the protection of human rights of people who had returned to North Korea from Japan and Japanese spouses, and the improvement of the various oppressions of the human rights especially in the political prisons in North Korea since the establishment in 1994. This time, in August 11, the Chinese public security authority officially noticed the arrest of Mr. Fumiaki Yamada (54), an assistant professor of Osaka University of Economics and a representative of our organization, to the Japanese Ministry of Foreign Affairs. According to the Chinese government, Mr. Yamada was arrested under the crime of aiding and abetting the illegal entry into China. According to the reports, Mr. Kiju Kim, a South Korean member of The Society to Help Returnees to North Korea (in his 40s), Mr. Sung Jin Kim, a South Korean journalist (42) and Mr. Myung Sup Keum, a South Korean journalist (31) were also arrested. North Korean refugees who are supposed to be under arrest are: 2 males in their 30s (second generation returnees) 1 female in her 30s (second generation returnees) 1 female in her 30s (North Korean national) 2 children (ages 7 and 1) 1 female in her 20s (North Korean national) 　 As several mass media have already reported, Mr. Yamada had been engaged in the rescue of North Korean refugees, especially the second generations of those who had returned to North Korea from Japan together with South Korean cooperators in China. They were arrested near the Japanese school in Shanghai when they were seeking refuge in the school in August 7. It is the obvious violation of the international laws, including the 1951 Convention on Refugee Status and the 1967 Protocol on Refugee Status, to unreasonably restrict them. These international laws precede the Chinese domestic laws on the illegal entry. Therefore, we ask you to request the Chinese government by the spirit of the human rights to immediately release Mr. Fumiaki Yamada, who was arrested and detained while he was working to rescue refugees, North Korean refugees, who are detained without no doubt and all the South Korean cooperators. Above all, we ask you deep from our mind to demand the Chinese government not to send North Korean refugees to North Korea where they will be severely punished as political criminals and will certainly be executed, and request the government to immediately allow refugees to leave for their intended destination. We consider that releasing them and permitting their exile strongly affect the international honor of China. The situation admits of no delay. This is the matter of the precious life of your brothers and sisters. Furthermore, Japanese Ministry of Foreign Affairs has clearly stated that people who returned to North Korea from Japan should be protected by the Japanese government as well as Japanese citizens responding to the requirement of many citizen's organizations which have been engaged in the North Korean human rights problems including The Society to Help Returnees to North Korea. We respect such stance of Japanese Ministry of Foreign Affairs from the viewpoint of the human rights protection. Therefore, we ask you to request the Chinese government by the spirit of the human rights diplomacy to immediately release Mr. Fumiaki Yamada, who was arrested and detained while he was working to rescue refugees, North Korean refugees, who are detained without no doubt and all the South Korean cooperators. These are our emergent requests to the Japanese Ministry of Foreign Affairs. 　 1. Please request the Chinese government to immediately release Mr. Fumiaki Yamada from the viewpoint of the protection of Japanese citizens. 2. It is clear from the reports of each human rights organization and UNHCR that North Korean refugees should be protected immediately. Please notice the Chinese government that it is their international obligation as a signatory of the refugee treaty not to send North Korean refugees, who are supposed to be detained now, to North Korea where they will be severely punished as political criminals, and demand the government to immediately allow refugees to leave for the country where they request. 3. According to the report of the Japanese Ministry of Foreign Affairs, Mr. Yamada was arrested under suspicion of aiding and abetting illegal entry. Mr. Yamada was certainly engaged in the rescue action of North Korean refugees with his cooperators. However, as the international human rights organizations have recognized and as the UNHCR also recognized recently, North Korean refugees should be protected by the refugee treaty, which your country also ratifies. If those refugees, who have had a contact with a staff of the human rights organization such as Mr. Yamada, were sent back to North Korea, they would be brutally tortured and sent to the horrible concentration camps. Getting out of the country is recognized as the political treason according to the North Korean criminal law, and it is obvious that they are political refugees. Mr. Fumiaki Yamada, his cooperators and North Korean refugees are not criminals. We consider that releasing them and permitting the exile of North Korean refugees to their intended destination affect the international honor of your country. These are our requirements. 　 1. Please release Mr. Fumiaki Yamada, who is detained now, immediately. 2. South Korean cooperators, who are supposed to be detained together, did not commit any crime according to the international law and on humanitarian grounds. Please release them immediately. 3. Please do not send North Korean refugees, who should be protected, to North Korea where they will be executed.
